N. J. Uncontested Divorce Worksheet


The NJ divorce kit is intended for uncontested divorces where there are no issues of alimony, child support and equitable distribution (division of property). The uncontested divorce kit will provide you with New Jersey approved forms of summons, complaint, final judgment of divorce and all other pleadings necessary to finalize a divorce. Also provided are transmital and filing letters to the necessary court clerks. This is a soup to nuts kit which merely requires that you place a stamp and mail the necessary correspondence. While there are numerous (Divorce Grounds) grounds for divorce in N J, this programs offer the two most commonly used grounds, No Fault (18 months separation with no prospect of reconciliation) and Physical or and/or Mental Cruelty. Grounds for Divorce

Grounds for divorce in New Jersey are numerous; however, two grounds are commonly used with uncontested divorces, No Fault Divorce and Crulety.

(1.) Divorce Grounds No Fault The No Fault divorce ground requires that the parties live separate and apart for a period of eighteen (18) months prior to the final divorce hearing. During the 18 months of separation, the parties must live in separate abodes and their must be no sexual relations. While there have been some cases litigated on the issues, if there is any doubt as to whether you qualify, you should file using the Cruelty ground for divorce.

(2.)Extreme Mental and Physical Cruelty. This is the most common and easiest fault ground for divorce. To prove this ground, it is necessary to recite five or six incidents during the marriage where your spouse may have embarrassed you in front of others or may have been insensitive to your feelings in some way. The cruelty can also be physical; however, it is not necessary to get too nasty since the Courts are liberal in interpreting cruelty. Judges usually will only ask you if you have read the allegations in the complaint and ask if they are true and accurate. It doesn't take much to prove cruelty in New Jersey today.
