The first question is whether or not the applicant will lose property to the trustee. Recent changes in the Bankruptcy code have
substantially liberalized the federal exemptions so that a husband and wife now are permitted $30,000 equity in real estate;
$4800 in equity in autos; $2000 in jewelry; $3000 in tools and books; an unlimited amount in ERISA qualified pensions
and other exemptions.
The $250.00 fee for the do-it-yourself Chapter 7 Kit includes a free initial telephone consultation (call 201-652-1113) to determine
if a Chapter 7 discharge or Chapter 13 wage earner plan is viable; to assure that your assets, if any, are exempt
and that your debt is dischargeable. The Chapter 7 discharge kit includes all schedules and transmittal letters
to the court, the debtor statement of intent, debtor's statement of financial affairs and affirmation agreements
if needed. If you decide to proceed, we will email you a list of records we will need to complete the schedules.
The Chapter 7 kit is intended for simple consumer bankruptcies. If you have a business, real estate holdings and
or a pension, you should seek an attorney to assure that these assets are not lost to the trustee or your petition
dismissed.
The process of filing a NJ Bankruptcy petition is too complicated to be processed entirely by filling out
forms. Counselling is needed to assure that your assets can be protected in a Chapter 7 discharge, that all of your debt is
dischargeable and that the discharge will not be barred for some other reason.
